CONSTITUTION OF THE UNITED SOUTH SUDAN AFRICAN PARTY


PART ONE:

Preamble

Recognizing the multi-Racial, Multi-Cultural and Multi-Religious character of the South Sudanese society;

Inspired by our long years of struggle to free ourselves from  injustice, torture and discrimination meted on our own South Sudanesecommunitybefore independence  by successive governments of old Sudan.

Aware of the struggle by our people in attempt to achieve peace and justice;

Disturbed by the prevalence of illiteracy and inadequacy of health and social services to our people; we strongly uphold and commit ourselves to the transformation of South Sudan into a democratic, decentralized and secular country;

We hereby adopt this constitution as the guideline by which USSAP shall be guided, and we pledge to respect and work with it.

1.      PRELIMANARY PROVISION          

This constitution shall be cited as the constitution of the United South Sudan African Party or USSAP 2012 as amended “in accordance with the political party Act 2012 and shall come into force when passed by the General Assembly andsign by the chairperson of USSAP.

2.      INTERPRETATION

In this Constitution unless the context otherwise requires:

§  Organization of USSAP”: means the organization of the United South Sudan African Party or USSAP.

§  Constitution: means the Constitution of the United South Sudan African Party or USSAP.

 

§  USSAP: means the political association called the United South Sudan African Party.

§  General Assembly: means the supreme Authority of USSAP at the national level.

§  Secretariat General:means the USSAP Secretariat at the national level

§  State Assembly: means the supreme authority of USSAP at the state level.

§  State political office: means the political executive authority of USSAP at the state level.

§  State Secretariat: means the secretariat of USSAP at state level.

§  County political committee: means USSAP executive authority at the county level.

§  County secretariat: means the secretariat of USSAP at county level.

§  Payam Assembly: means the supreme authority of USSAP at Payam level.

§  Payam political committee: means the USSAP Executive office at the Payam level.

§  Payam secretariat: means the USSAP secretariat at the Payam level.

§  Boma Assembly: means the supreme authority of USSAP at the Boma level.

§  Boma Secretariat: means the USSAP secretariat at the Boma level.

 

PART TWO

3.      PRINCIPLES AND OBJECTIVES:

USSAP shall be guided and stand by the following principles and objectives:

(1)   Sanctity of human beings and individual right to life.

(2)   Respect for personal property.

(3)   Unity in diversity and peaceful coexistenceamong thepeople of South Sudan.

(4)   Freedom of thought, worshiping, beliefs and preaching of faith.

(5)   Freedom of press and Association.

(6)   Equality of all citizens before the law.

(7)   Right to work and social protection.

(8)   Non-discrimination on basis of race, religion, ethnicity, sex, or creed.

(9)   Democracy, decentralization and good governance.

 

 

PART THREE

4.      ESTABLISHMENT OF USSAP:

There shall be established a party in the provisions of this constitution a political party known as the United South Sudan Africa Party and shall have:

(1)   Corporate personality, perpetual succession and shall sue and be sued in its own name and seal.

(2)   The headquarters shall be at the national capital of the Republic of South Sudan.

(3)   Shall have an appropriate emblem to be used in all its publications and during its activities.

(4)   The membership of USSAP shall be open to all South Sudanese citizen who has attained the age of [18] eighteen years and above.

(5)   A member of USSAP shall be a person who has voluntarily declared his/her desire to join USSAP.

(6)   A member shall obey and abide by the principles and objectives of USSAP and the provisions of its constitution.

(7)   The institution of USSAP shall be established from the lowest level to the highest level; that is fromBoma to the National level.

(8)   In the event of elections at any level of USSAP there shall be one person one vote.

 

5.      MEMBERSHIP

Condition for membership

Membership of USSAP party shall be open to all South Sudanese who attain the age 18 years and above and that person;

(1)   Shall be of sound mind;

(2)   Shall be of moral support and honesty;

(3)   Shall abide with principles, objectives and the constitution of the USSAP;

 

6.      RIGHTS AND DUTIES OF A MEMBER

A member of USSAP shall have the following rights and duties

(1)   Shall have right to be nominated and contest for any election within the party and the general elections

(2)   Shall attend the general meeting of the party and have rights to vote and be voted as leader of the party.

(3)   Shall have right to raise any motion or any problems of concerns to the secretary general for discussion.

(4)   Shall abide by the principle objectives of the party in accordance to this constitution.

(5)   Shall respect opinions of others in the meeting and accept internal critics as abide by the rule of democracy.

(6)   Shall have a duty to propagate and promote party policies and programs to realize the objectives and principles of the party.

(7)   Shall generallymobilize funds for the benefits of the party in accordance to Political Party Act, 2012;

(8)   A member shall voluntarily support the activities of the party at all levels to achieve its aims and objectives.

 

7.      LOSS OF MEMBERSHIP

Membership of USSAP shall be lost through the following reasons:

(1)   Not attending the meeting for three consecutive months without proper reason or not loyal to the party;

(2)   Personal resignation letter  in writing to the chairperson or defection to another party;

(3)   Dismissal through disciplinary committee for gross-misconduct or violation of this constitution and the rule and regulations of USSAP;

(4)   Insanity or death

 

PART FOUR

STRUCTURES AND ORGANIZATION:

8.      STRUCTURES AND ORGANIZATION AT NATIONAL LEVEL

The structure and organization of USSAP at national level shall be as follows:

a.       The General Assembly

b.      The Political Bureau

c.       The General Secretariat

 

PART FIVE

THE POWERS AND FUNCTIONS OF NATIONAL ORGANS

9.      [a] THE GENERAL ASSEMBLY:

(1)   The General Assembly shall consist of equal number of delegates elected from the states, provide that30% thirty percent of whom shall be women and shall have the following powers and functions:

(2)   Shall be the supreme authority of USSAP;

(3)   It shall be the policy making body of USSAP at national level

(4)   It shall elect the national chairperson, his/her Deputy, and the Secretary General and his/her Deputy and the members of National Political Bureau.

(5)   Shall have the powers todissolve the political bureau;

(6)   The General Assembly shall hold its conventions after every four years

(7)   The General Assembly may hold its extra-ordinary convention at any time when required by two thirds majority of its members or only by decision of the national political bureau or chairperson when there is an urgent need.

 

10.   [b] THE POLITICAL BUREAU

The Political Bureau shall consist of twenty five (25) members including chairpersons of the state Political offices, two representatives from youth and women sectors, provided that state chairpersons are not given assignments in the National Secretariat.

The powers and functions of the National Political Bureau shall be as follows:

(1)   Shall act in the absence of the General Assembly and shall make rules and regulations thereon.

(2)   Shall be responsible for calling of both ordinary and extra-ordinary meetings of the General Assembly of USSAP.

(3)   Shall be responsible for executing the policies, programs and resolutions of the General Assembly.

(4)   Shall be responsible for selecting candidates for constitutional posts at the National level.

(5)   Shall confirm or reject the recommendations of state political office for appointments to constitutional post at the state level.

(6)   Shall prepare USSAP annual budget and final accounts report and present it to the General Assembly for approval.

(7)   The meeting of the Political Bureau shall be chaired by the chairperson or his/her Deputy.

(8)   The Political Bureau may, form standing committees for specifics duties and functions.

 

11.  [c] THE GENERAL SECRETARIAT OF POLITICAL BUREAU

The secretariat of the political bureau shall consist of thirteen (13) offices as follows:

1.      The chairperson.

2.      The vice Chairperson

3.      The Secretary General

4.      Deputy Secretary General.

5.      Secretary of Finance & Economic Affairs;

6.      Secretary for Membership recruitment & Mobilization

7.      Secretary for Education, planning & Training;

8.      Secretary for Fundraising;

9.      Secretary for Information & Communication;

10.  Secretary for External Relations;

11.  Secretary for Legal Affairs & Policy Research;

12.  Secretary for Women & Gender Affairs;

13.  Secretary for Syndicated organization& Students Affairs;

 

 

 

 

PART SIX

12.  POWERS AND FUNCTIONS OF THE NATIONAL CHAIRPERSON

THE CHAIRPERSON

SHALL:

(1)   Preside over the meetings of the Political Bureau and General Assembly and any other meetings of USAP.

(2)   Represent the party in all its contacts with other similar political parties.

(3)   Appoint representatives or delegations to represent him/her in specific missions or matters.

(4)   Strategize the policies and motivate party members to realize the party principles and objectives.

(5)   Nominate and recommend any person to fill any vacant position in the event of dismissal, resignation or death of any party member with the approval of the Political Bureau.

 

13.   THE DEPUTY CHAIRPERSON

(1)   Assumes the functions and powers of the chairperson in his/her  absent for any reason to perform his/her duties;

(2)   Represent the party on assignment by the chairperson

(3)   In the event of the position of the chairperson fall vacant, the Deputy Chairperson shall assume the office of the chairperson to complete the remaining term until the general assembly is convened to elect a new chairperson.

 

14.  SECRETARY GENERAL

SHALL:

(1)   Assume the functions and powers of the chairperson, Deputy Chairperson in the event of their absence in office.

(2)   Prepare the agenda of the meetings in consultations with the chairperson.

(3)   Record the minutes of the meetingsof political bureau.

(4)   Be the custodian of all the party documents and its seal.

(5)   Prepare quarterly reports of the party on its performance.

(6)   Run day to day affairs of the party and ensure that plan and policies of the party are executed.

(7)   Direct and receive report from various state offices through state chairperson and report the same to the chairperson of the party.

 

15.   THE DEPUTY SECRETARY GENERAL

SHALL:

(1)   Assume the powers and functions of the Secretary General in his/her absence.

(2)   Be given any assignment by the Secretary General or his/her vice or the Secretary General.

16.  SECRETARY FOR FINANCE AND ECONOMIC AFFAIRS

SHALL:

(1)   Be responsible for the finance of the party

(2)   Collect the monthly subscriptions from members and donations from any goodwill individuals or organizations.

(3)   Report to the political bureau quarterly on the financial position of the party.

(4)   Prepare economic policies and studies and propose activities for fund raising for consideration and adoption by the political bureau.

(5)   Prepare the budget for the party.

(6)   Supervise party financial projects.

 

17.  Secretary for Membership recruitment & Mobilization

SHALL:

(1)   Organize and program ways and means of recruitment to the party.

(2)   Mobilize and register admission of new members to the party.

(3)   Explain the objectives and programs of the party with the aim of attracting membership.

(4)   Plan, coordinate and establish sub-offices in the states within the country.

(5)   Hold rallies when there is need.

(6)   Plan for alliance with other parties.

(7)   Coordinate mobilization with other parties.

(8)   Organize and coordinate the conduct of the public rallies with other parties.

(9)   Make contacts for inter-party meetings.

 

18.  Secretary for Education, planning & Training;

SHALL:

(1)   Look for educational opportunities for those in need.

(2)   Work and plan for opening of schools with relevant authorities.

(3)   Supervise/monitor the intake to all levels of the education systems in the country.

(4)   Supervise and plan for curricula and syllabuses at all levels of education.

(5)   Look for and find ways and means foe securing scholarships.

(6)   Plan for the scientific research and establish national library to enable the party members to carry out research and policy development.

19.  Secretary for Fundraising;

The Secretary for Fundraising shall:

(1)   Solicit for fund and organize fundraising activities to generate fund for the party;

(2)   Be a focal Point of contact with any goodwill organization or individuals for financial assistance;

(3)   Increase the revenue of the party by any legal means necessary to raise money for the party;

 

20.  Secretary for Information & Communication;

SHALL:

(1)   Design policies to arrive at the proper ways of disseminating information to the party members of the General Assembly and political bureau and the allied political groups.

(2)   Notify the members of the General Assembly and political bureau and the secretariat about the meetings time and their venue.

(3)   Be the official spokesperson of the party.

(4)   Design means and ways for the publication of a newsletters or newspapers, or magazine for the party.

(5)   Design means of encouraging fair shows, exhibitions and cultural festivals.

 

21.  SECRETARY FOR EXTERNAL RELATIONS

SHALL:

(1)   Establish links between USSAP and regional and international diplomatic missions accredited to SouthSudan.

(2)   Establish contacts with regional and political movement with similar ideologies and programs.

(3)   Establish contacts with regional and international non-governmental organizations in order to exchange knowledge and experience with South Sudanese societies.

(4)   Encourages some South Sudanese youth to pick up interests in diplomacy.

 

22.  Secretary for Legal Affairs & Policy Research;

SHALL:

(1)   Be responsible for the custody of all legal instruments of USSAP.

(2)   Interpret legal provisions therein.

(3)   Render legal advice to the political bureau of the party on all the legal matters.

(4)   Prepare amendments that may be suggested in any of the legal documents.

(5)   Render legal options on any legal matters including human right issues.

23.  Secretary for Women & Gender Affairs;

(1)   Shall ensure to establish kindergarden

(2)   Ensure and safe guard gender issues and programs for women on all occasion.

(3)   Plan and work on ways and means for the protection of both women and child rights.

(4)   Follow up for immunization of children to eradicate child mortality rate and mother healthcare.

(5)   Empower women participation in political arena of South Sudan to promote gender equity in the country and ensure that 30% women representations are implemented at all party levels.

 

24.  Secretary for Syndicated organization and Students Affairs

The secretary shall:

(1)   Initiate sound policies for youth welfare and ensure their development moral and physical protection against abuses and abandonment.

(2)   Build up culture of peace, non-violence and unity among the youth through holding conferences, workshop, camping activities and sport competitions.

(3)   Discourage youth from rural migration to urban areas.

(4)   Promote different sports activities and support them for their success.

 

25.  Deputy Secretaries

The Deputy Secretaries for all secretariats shall:

(1)   Assume the powers and functions of their direct secretaries when they are absent for any reason that disabling them to perform their duties.

(2)   Represent the party on assignment from the chairperson, secretary general or their direct secretaries.

 

PART SEVEN

26.  STATE STRUCTURE

The structures and organization of USSAP at the state level shall be as follows:

a.       The State Assembly.

b.      The State Political Office.

c.       The State Secretariat.

The composition of the State Assembly

The State Assembly shall comprise of elected members of equal number of delegates from the counties provide that 30% of whom shall be women.

Functions and powers of the State Assembly

(1)   The state assembly shall be the supreme authority of USSAP at the state level and shall elect the state chairperson and his/her deputy, the state secretary and his/her deputy and the members the state political office

(2)   Shall have the power to dissolve the state political office in consultation with National Political Bureau in case of leadership crisis.

(3)   Shall approve the state policies and plan and the annual budget

(4)   Shall meetonce after every four years and it may holds extra-ordinary meeting at any time when requested by two third members of the state political office or by the chairperson when there is an urgent need.

 

27.  The state political office

Compositions

The state political office shall consist of fifteen [15] members including the chairperson of the county political office provide that they shall not be assigned duties at the state secretariat.

Powers and function of the state political office shall be as followed:

(1)   Shall act in the absent of the state assembly

(2)   Shall be responsible for calling of both ordinary and extra-ordinary meetings of the state assembly.

(3)   Shall be responsible for executing the policies, programmes and resolutions of the state assembly.

(4)   Shall select candidates for the constitutional post holders at the state level and recommend them to the National Political Bureau for approval or rejection.

(5)   Shall prepare the annual budget and final accounts and present it to the state assembly for approval.

(6)   The state political office shall meet twice a month but it may convene extra-ordinary meeting at any time when requested by two third of its members or the chairperson.

(7)   The chairperson shall chair the meeting of the state political office, but in the event of the absent of the chair, the deputy shall chair the meeting of the state political office.

(8)   The state political office may form standing committee for specifics duties and functions.

 

28.  STATE SECRETARIAT

Composition

(1)   The state secretariat shall consist of 7 offices and their functions shall be determined by the state political office.

(2)   The state chairperson may appoint some members of political office as Assistant secretaries with specifics assignment.

(3)   Such Assistant Secretaries may be co-opted into the meeting of the Secretariat individually or severally when there is a need.

PART EIGHT

29.  COUNTY STRUCTURE

The county structure and organization of USSAP at the County Level shall be:

a.       The County Assembly

b.      The political Committee

c.       The County Secretariat

Powers and functions of the County Assembly:

The county assembly shall comprise of equal members elected from the Payam.

(1)   The county assembly shall be the supreme authority of USSAP Party at the County level;

(2)   Shall be the policy making body of USSAP in the county;

(3)   Shall elect the county chairperson, his/her deputy, the county secretary and his/her deputy and members of the county political committee;

(4)   Shall have the authority to dissolve members of the county political committee in consultation with State Political Office;

(5)   Shall approve the county plan and annual budget;

(6)   The county assembly shall holds its conference once every four  years and may holds extra-ordinary conference at any time when called upon by the two third of its members or by the political committee or the chairperson when there is an urgent need.

 

30.  THE COUNTY POLITICAL COMMITTEE

Compositions

The county political committee shall consist of [10 ] ten  members of the county political committee including the chairperson of Payam political committee provide that he/she shall not be assigned duties at the county secretariat.

Powers and function of the county political committee

(1)   The county political committee shall act in the absent of the county assembly;

(2)   Shall be responsible for calling of bothordinary and extra-ordinary meetings of the county assembly;

(3)   Shall be responsible for executing policies and the resolutions of the county assembly;

(4)   Shall prepare the annual budget and financialstatement and present it to the county assembly for approval;

(5)   Shall supervise the performance of county secretariat;

(6)   The chairperson of the county political committee shall chair the meeting and in the event of his/her absent, the deputy chair shall act to chair the meeting of the county political committee;

(7)   The county political committee may form a standing committee with specifics duties to run it affairs.

 

31.  THE COUNTY SECRETARIAT

(1)   The county secretariat shall comprise of [5] five  members whose functions shall be determined by the county political committee;

(2)   The chairperson may appoint some members of the political office as Assistant Secretaries with specifics duties’

(3)   Such Assistant Secretaries may be co-opted into meetings of the secretariat individuals or severally when there is a need.

PART NINE

32.  PAYAM STRUCTURE

The structure and organization of USSAP at the Payam level shall be as followed:

a.       The Payam Assembly

b.      The Payam Political committee

c.       The Payam Secretariat

Composition of the Payam Assembly

The Payam Assembly comprise of elected members of equal number from Boma units constituting the Payam, provide that 30% of whom shall be women.

Powers and functions of the Payam Assembly

(1)   The Payam Assembly shall be the supreme body of USSAP at the Payam level.

(2)   Shall be the policy making body of USSAP at that level;

(3)   Shall elect the Payam chairperson, Deputy Chairperson and members of the political committee;

(4)   Shall approve the plan and annual budget of USSAP;

(5)   Shall holds its conference after every four years and extra-ordinary meeting may be convened at any time upon request by two third majority members or by the chairperson when there is an urgent need or by the political committee.

 

33.  THE PAYAM POLITICAL COMMITTEE

Compositions of the Payam Political Committee

The Payam political committee shall comprise of [7] members elected by the Payam Assembly including the chairperson of the Boma provide that he/she shall not be assigned duties in the Payam secretariat.

Powers and functions of Payam Political Committee

(1)   The powers and functions of the Payam political committee shall be as followed:

(2)   Shall act in the absent of the Payam assembly meeting;

(3)   Shall be responsible for calling of both ordinary and extra-ordinary meetings of the Payam Assembly;

(4)   Shall be responsible for executing the policies and programme of the assembly;

(5)   Prepare the annual budget and final accounts report and present it to the general assembly for approval;

(6)   Shall supervise the performance of the Payam secretariat;

(7)   The chairperson of political committee shall chair the meeting and in the event of his/her absent, the Deputy chair shall chair the sitting of the political committee;

(8)   The political committee may form standing committee with specific duties to run its affairs.

 

34.  THE PAYAM SECRETARIAT

(1)   The Payam Secretariat shall comprise [5] members and the functions of their office shall be determined by the Payam Political Committee;

(2)   The chairperson may appoint some members of the political committee as Assistant Secretaries with specific assignments.

(3)   Such Assistant Secretaries may be co-opted into meetings of the secretariat individually or severally the need arises.

 

PART TEN

35.  BOMA STRUCTURE

The structure and organization of USSAP at Boma level shall be as followed:

a.       The Boma Assembly

b.      The Boma Political Committee

c.       The Boma Secretariat

Composition of the Boma Assembly

The Boma Assembly shall composed of members of equal numbers elected from villages or urban quarters constituting the unit or Boma provide that 30% of whom shall be women.

Powers and functions of the Boma Assembly shall be as followed:

(1)   The Boma Assembly shall be the supreme body of USSAP at the Boma level;

(2)   Shall elect the Boma Chairperson, Deputy Chairperson, Boma Secretary and members of the Boma Political Committee;

(3)   Shall be the policy making body of USSAP;

(4)   Shall have powers to dissolve the Boma Political Committee after the end of their term in office in consultation with Payam Political Committee;

(5)   Shall approve the annual budget;

(6)   Shall holds Boma Congress after every four  years and extra-ordinary congress may convene at any time when called upon by two third of its members or the Boma Chairperson or the Boma Political Committee when there is an urgent need.

 

36.  THE BOMA POLITCAL COMMITTEE

The Boma Political Committee shall comprise of [5] members elected by the Boma Assembly from among its members;

 

The powers and function of Boma Political Committee shall be as followed:

(1)   Shall act in the absent of Boma Assemble;;

(2)   Shall be responsible for calling both ordinary and extra-ordinary meetings of the Boma Assembly;

(3)   Shall be responsible for implementing the programme of USAP at that level;

(4)   Supervise the performance of the Boma Secretariat;

(5)   The chairperson of Boma Political Committee shall chair a meeting and in the event of his/her absent, the Deputy chair shall chair the sitting of the Boma Political Committee;

(6)   The Boma Political Committee may form a standing committee with specific duties to run its affairs.

 

37.  THE BOMA SECRETARIAT

(1)   The Boma Secretariat shall consist of [3] members appointed by the Boma Political Committee and their functions shall be determined by the Boma Political Committee.

(2)   The Chairperson may appoint Assistant Secretaries with specific functions to assist the Secretaries;

(3)   Such assistant shall be allowed to attend the meeting of the secretariat individually or severally when there is a need.

PART ELEVEN

38.  TENURE OF THE OFFICE OF THE CHAIRPERSON OR ANY OTHER OFFICES

The term of office for the Chairperson of Political Bureau and the General Secretariat at all levels shall be four years in office and shall be effective from the date of taking oath of office.

39.  NEGLIGENCE OF FUNCTIONS AND DUTIES

Any member who neglects duties and functions assigned to him/her in accordance to this constitution shall be dealt with as follows:

(1)   When the majority of the members of political bureau notify that a member has stopped or ineffective without charging his/her duties and functions for three consecutive months without notifying the office concerned, the chairperson ofthe Political Bureau or any level after consultation with the absent individual shall notify the Secretary General or Secretary to declare the seat vacant.

(2)   In the event of the dismissal or resignation of any member of the political bureau, or any other political offices at any level, the chairperson shall immediately notify the Secretary General or secretary in case of state to declare the seat vacant from the date of dismissal or from the date on when the resignation took effect.

(3)   Any member or member of political bureau who resigns shall tender his /her resignations in writing to the chairperson and copy secretary general or secretary in case of state and steps aside to declare the seat vacant.

(4)   When the seat falls vacant in the political bureau or at any level of the party, the chairperson of USSAP or the chairperson at any level shall recommend three members within 30 days in consultation with political bureau at the national level or political office at any level and thereafter, the political office shall approve one person among the three to fill the post.

 

40.  OATH OF OFFICE

Before assuming office, any member of political bureau, political office or political committee who is elected to fill the vacant position shall take the oath of commitment at the sitting of political bureau or political office of any level and shall pledge as follows:

I_____________________“swear in the name of Almighty God to carry out my duties faithfully in all honesty and with impartiality and God is my witness.”

PART TWELVE

41.  MEETINGS

Session and meetings of Political Bureau or Political Office and Secretariat at all levels shall be as followed:

(1)   The Political Bureau or political office or secretariats shall holds ordinary meeting twice in a month as necessary or extra-ordinary meeting may convene so as to enable them executing their functions and duties satisfactorily in conformity with principles and objectives by which USSAP party stands.

(2)   The secretariat meeting shall be convened on the date of the week which shall be fixed by the Political Bureau or political office at any level on the proposal of the chairperson in consultation with secretary general or state secretary in case of the state, county, Payam and Boma structures shall follow the same.

(3)   The decision at the meeting of USSAP at all level shall be made by simple majority, and in the event of contentious issue shall be determined by vote or showof hands or secret ballots may be adopted if demanded by two third majority of members in that sitting.

PART THIRTEEN

42.  FINANCE AND SOURCES OF REVENUE

The party sources of Finance and revenue shall consist of the following:

(1)   Membership registration fee which shall be determined by the party internal regulations;

(2)   Monthly subscriptions fee from the members;

(3)   Income from the investment of USSAP Party

(4)   Donation and contribution from individuals, organizations or national NGOs companies;

(5)   Any public fund from the government

 

43.  DISSOLUTION OF THE PARTY

The party shall not be dissolved unless the political bureau may resigns or be dissolved as followed:

(1)   Written withdrawal of confident from the chairperson of the Political Bureau or resignation of more than half of the members of political Bureau and that dissolution shall be approved by [2/3] two third majority members of the General Assembly.

(2)   Merge with other party and that merging shall be made in writing and approved by the two third majority of the General Assembly.

(3)   In the event of the dissolution, the asset of the party shall be transferred to any charity organization or the government and such a decision shall be approved by the two third majority of the General Assembly.
